Well - that's the same misuse proxying is... and WotC isn't barreling down on it as much as they are if it goes commercial...
Now - from Ebay - WoTC is tracking down individuals that have made proxies of cards and were selling them via ebay or other means... so I guess it depends on whether or not you're making money off of their "intellectual property"...
