Received email back from friend who is copyright and trademark attorney. In his opinion, this is Fair Use, non-commercial and in one's own home.

So, I guess my kids will ocntinue making up prozies of there favorite cards and I'll have to deal with some new threats in their decks.

Crackdown isn't attempting to sell the cards, or trade them to others. He has said that nobody could actually mistake them for real cards. He's only doing it to avoid playing with cards with scribbles on them. I am certain there is nothing wrong with it.

Have you never used a proxy before, K9?

I think it's fine since Crackdown clearly stated what he's using it for and no one's going to mistake them for the originals. It's no different than taping your CD on a tape so you can listen to it in you cassette only car...

This is also no different than burning a CD.

If you burn it for you, that's fine.
If you burn it and then sell it, that's not.
