I think mentioning sending a C&D letter would have been irrevelant, since it already came to a lawsuit. And I don't think RE would have mentioned it because what good that do? "Yeah, I got a C&D letter but I ignored it, so now I'm getting sued". I don't even see WOTC suing him for money...

Isn't a Cease & Desist letter a prelude to a suit? In other words, if the party ignores the letter, they get sued? I don't think it was just images, although maybe it was specifically in this case. It was the general principle that images or cards comprised WOTC property that was being...
